KcalTap Terms of Use

You must be at least 18 years old and legally capable of entering a contract. KcalTap is not designed for children or minors. You may use KcalTap only where permitted by applicable law.

KcalTap is a general wellness, nutrition-recording, activity-review, and fitness-tracking tool. It is not a medical device or healthcare provider and is not intended to diagnose, treat, cure, mitigate, monitor, or prevent disease or injury. It does not provide emergency services, prescriptions, professional supervision, medical clearance, allergen verification, or guaranteed results.

The Health and Safety Disclaimer is part of these Terms. Stop using a feature and seek appropriate professional or emergency help when symptoms, injury, allergy risk, pregnancy, an eating disorder, medication, or another health condition makes self-directed use inappropriate.

• Provide accurate account information and keep it current.
• Protect your password, verification codes, device access, and recovery links.
• Do not share an account in a way that defeats plan limits or security controls.
• Notify us promptly if you suspect unauthorized access.
• You are responsible for activity performed through your account unless prohibited by law.

Subject to these Terms, KcalTap grants you a limited, personal, non-exclusive, non-transferable, revocable license to use the app for lawful personal purposes. You may not:

• Copy, sell, rent, sublicense, reverse engineer, bypass, scrape, or exploit KcalTap except where law expressly permits.
• Evade subscriptions, entitlement checks, usage limits, rate limits, or security measures.
• Upload malicious code, interfere with the service, probe systems without authorization, or misuse APIs.
• Use KcalTap to violate law, infringe rights, harass others, or submit content you are not allowed to provide.
• Use automated or AI features to seek instructions for emergencies, medical diagnosis, unsafe restriction, self-harm, illegal conduct, or dangerous training.

You retain ownership of information you enter. You grant KcalTap a limited license to host, process, transmit, format, calculate, and display that information only as needed to provide, secure, support, and improve the service, comply with law, and enforce these Terms. The Privacy Policy explains the data practices that apply.

You are responsible for reviewing entries and correcting mistakes. Do not submit passwords, full payment-card details, government identifiers, or unnecessary medical records through food notes, workout notes, AI prompts, or support forms.

Food database, barcode, serving, restaurant, and calculated values may be incomplete, outdated, mismatched, or wrong. Product recipes and manufacturing practices can change. Check the current package label and manufacturer information. Never rely on KcalTap to determine whether food is allergen-free, uncontaminated, suitable for a prescribed diet, or safe for a particular person.

Workout routines, previous-set references, estimated calorie expenditure, body-composition trends, and estimated one-repetition maximums are informational estimates. They are not real-time supervision, technique analysis, injury evaluation, or proof that a load or exercise is safe. You are responsible for equipment, surroundings, spotting, progression, recovery, and obtaining professional clearance when needed.

AI output may be inaccurate, incomplete, inconsistent, or inappropriate. Review it before acting. KcalTap Coach is not medical advice, a diagnosis, a prescription, professional supervision, or an emergency service. It may provide general educational nutrition, training, recovery, and return-to-training ideas when you describe the clearance and restrictions supplied by a qualified professional.

KcalTap Coach does not replace or change an individualized rehabilitation plan, diagnose a setback, set a return-to-sport timeline, provide medication dosing, verify allergen safety, issue medical clearance, or override a clinician. Do not rely on it for active severe symptoms, pregnancy-specific medical care, eating-disorder treatment, or instructions to train through concerning pain.

Availability, models, limits, and output may change. KcalTap may block, limit, review, or refuse requests to protect users, providers, and the service.

• Apple displays the final localized price, duration, introductory offer, and renewal terms before you confirm a purchase.
• Auto-renewable subscriptions continue until renewal is canceled through Apple’s subscription settings.
• Deleting the app or your KcalTap account does not cancel an Apple subscription.
• Apple controls billing, payment methods, taxes, refunds, and purchase restoration for App Store purchases, subject to Apple’s rules and applicable law.
• When paid access ends, paid actions and screens may become unavailable. Export records you need to keep.

A subscription includes only the features described as currently available for that plan in KcalTap and Apple’s product description at the time of purchase. Planned, future, beta, experimental, or previewed features are not promised, may change, and should not be the basis of a purchase.

KcalTap may rely on Apple, food databases, hosting providers, authentication providers, AI providers, and other third parties. Their information and services may be unavailable, delayed, inaccurate, or subject to separate terms. KcalTap is not responsible for third-party products or conduct to the extent permitted by law.

We may add, remove, limit, suspend, or change features to maintain security, legal compliance, service quality, or business viability. We do not guarantee uninterrupted operation, indefinite storage, cloud restoration of every data type, or continued support for every device or provider.

You may stop using KcalTap and delete your account. We may suspend or terminate access for violations, fraud, abuse, security risk, legal requirements, or discontinuation. Provisions that by their nature should survive termination—including ownership, disclaimers, limits of liability, and dispute terms—will survive.

KcalTap and its software, designs, branding, documentation, and original content are protected by law. Third-party names and data remain the property of their owners. When you submit product feedback, you allow KcalTap to use it without restriction or compensation, provided we do not publicly identify you without permission.

To the fullest extent permitted by law, KcalTap is provided “as is” and “as available.” We disclaim express and implied warranties, including merchantability, fitness for a particular purpose, accuracy, non-infringement, safety, availability, and results. Some jurisdictions do not allow certain disclaimers, so portions of this section may not apply to you.

To the fullest extent permitted by law, KcalTap and its operator, affiliates, personnel, and providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages; lost data, revenue, profits, opportunities, or goodwill; personal decisions based on estimates; or inability to use the service. Our aggregate liability for claims relating to KcalTap will not exceed the greater of the amount you paid KcalTap through the App Store during the 12 months before the event giving rise to the claim or US $100.

These limits do not apply where prohibited, including liability that cannot legally be limited. Your local consumer rights remain unaffected.

To the extent permitted by law, you agree to defend, indemnify, and hold KcalTap and its operator harmless from third-party claims arising from your unlawful misuse of KcalTap, violation of these Terms, or infringement of another person’s rights. This does not require you to indemnify KcalTap for KcalTap’s own unlawful conduct.

Except where mandatory consumer law provides otherwise, these Terms are governed by the laws of the Commonwealth of Virginia, without regard to conflict-of-law rules. Courts with lawful jurisdiction in Virginia may hear disputes. Before filing a claim, each party agrees to send written notice and make a reasonable good-faith effort to resolve the dispute informally for at least 30 days, unless immediate relief is legally necessary.

We may update these Terms. The current version and effective date appear above. When an update requires renewed agreement, KcalTap may require acceptance before continued use. Continued use after an effective update constitutes acceptance where permitted by law.
